Do you know about the new packaging law?

Did you know that since January, all companies that place products on the market are required to comply with the packaging law? At AGR, we help you comply with it.


It's an european law aimed at reducing waste. Are you ready?


We'll help you if you are not registered as a waste producer. We can do it on your behalf. Moreover, whether you are registered or not, we'll support you in complying with the regulations regarding visual identity and logo usage to meet the requirements.

  


International Productions

In case of international productions, since the regulation isn't harmonized at European level, each country's specific requirements must be met.


If the product is going to be distributed in Spain, we handle the process to ensure it complies with the Spanish packaging law.


In other cases, it is important you make sure to comply with the regulations of each country where the game is going to be distributed.


On our side, since the regulations are similar, we will do our best to support you, and we already have experience managing compliance in several countries.

What does the law require?

According to the spanish Royal Decree 1055/2022, all packaged products placed on the spanish market must include a packaging declaration.


This declaration can be made by the legal producer of the product, or by the manufacturer if they are listed as responsible on the packaging. That's where we come in to help you.


This means you must either register as a packaging producer, or delegate the declaration on us so we can do it on your behalf.


What does AGR service include?

If AGR files the packaging declarations on your behalf, we take care of:

  • Register the packaging data (plastic, carboard, etc.).



  • Submitting the annual declaration, including the calculation of the Green Dot fee.


  • Make sure that environmental labeling complies with regulations.

  • Mantaining traceability over

What should you do if you declare it yourself?

  • Register your company with spanish MITERD.  

  • If your packaging is for household and/or commercial use, you must register with a SCRAP and present an annual declaration for each packaging type.

  • Calculate all the packaging genreated by your product.

  • Properly include the recycling and material symbols on the packaging.

  • Keep all documents for 5 years.



Marking and logos

Whether you handle the declaration yourself or we do it for you, at AGR we will make sure you use the correct logos and that the board game complies with this and all other applicable regulations.




What happens if I don't declare?

It is a legal violation that can result in fines of up to 600.000€.



Other regulations

Remember that you must also comply with the EN71 regulation. Our prepress team will ensure you meet it correctly and will provide you with all the necessary resources. Failure to comply may lead to issues with distributors as Amazon, who may not allow you to use their platforms.


Additionally, we are awaiting new regulations such as EUDR, which affects to the origin of the paper, cardboard and wood. Manufacturing process like the one we use at AGR will help make compliance easier.
